ARS VIANA TERMS, CONDITIONS AND POLICIES FOR SHIPPING, RETURNS AND PROCESSING OF INFORMATION AND PRIVACY.

What are the terms and conditions of ARS VIANA?

ARS VIANA is an entrepreneurship by artists Hugo & Alejandro Viana, whose mission and vision is to disseminate, promote and market their art project nationally and internationally through their e-commerce platform, which uses the technology services of the Shopify electronic platform with the Payment Gateway service providers PayPal and PayU.

ARS VIANA offers the buyer of its online store an e-commerce platform so that they can make their online purchases in an agile, efficient and secure manner, safeguarding the treatment of information and privacy in accordance with the Terms, Conditions and Services offered by its Shopify platform with its corresponding associated Payment Gateway providers.

The buyer of the ARS VIANA online store may purchase and acquire any of the limited edition works offered, complying with the following terms and conditions: 1. Enter ARS VIANA; 2. Select the Work; and 3. Make the Purchase; ARS VIANA undertakes with the buyer to: 1. Carry out and verify the electronic transaction; 2. Carry out the on-demand Edition of the acquired work; and 3. Make the corresponding shipment and delivery of the certified work within a period not exceeding 60 days.

ARS VIANA reserves the copyright and intellectual property rights of the works purchased, providing the buyer with their respective certificates of authenticity and ownership. It also reserves the right to the shipping and return policies set out below.

How do I track my order at ARS VIANA?

Once the order has been dispatched, ARS VIANA will send an electronic link for tracking. If the buyer has any questions about their shipment, they can contact the seller via WhatsApp: +57 3227716221 or by email: artprojectviana@gmail.com

When will I receive my ARS VIANA order?

Our limited digital editions of Drawing, Painting, Photography and other products from our ARS VIANA online store are made to order and in a personalized manner once the purchase is confirmed, complying with the highest quality standards based on three development phases that include:

1. Digital Printing in Fine Art Giclée.
2. Handling and Packaging of the works.
3. Insured Shipping.

This process can take between 4 and 8 weeks, depending on the volume of work and availability of our publishing service provider, the handling and packaging time of each piece of art and its dispatch and delivery to the buyer. Once the work has been shipped by our logistics operator, we will send the respective tracking number so that the buyer can track it.

My order should have arrived by now, but I haven't received it yet. What do I do?

Before processing the shipment, we will request rectification of the address provided by the buyer, and once the order has been dispatched, the buyer will receive the corresponding tracking number. Likewise, our logistics operator will contact the recipient to coordinate the delivery of the order to their satisfaction within the estimated time.

What is ARS VIANA's return policy?

We do not offer refunds or exchanges for purchased works because they are unique pieces in limited, catalogued and certified digital editions. Therefore, our professional career and artistic production with 30 years of experience guarantees the acquisition of art pieces with certification of authenticity, copyright and letter of ownership, complying with the highest quality standards in alliance with our publishing operator that guarantees high-definition prints and our logistics operator that guarantees the proper handling, transportation and delivery of each work.

What is ARS VIANA's right of withdrawal policy?

When the buyer, directly purchases a piece of art from the ARS VIANA online store, has previously read and accepted the terms and conditions of our shipping, return and withdrawal policies, which is why exercising the right of withdrawal by the buyer after the purchase has become effective is not applicable in this specific case of an e-commerce transaction.

What is the Policy on possible claims from the buyer?

ARS VIANA reserves the right of non-refund and is not responsible for possible claims arising from the sale of any of the works acquired by the buyer.

What is ARS VIANA's copyright policy?

Artists Hugo and Alejandro Viana reserve the copyright © and all intellectual property rights, moral rights, material rights and reproduction rights of each work sold in their ARS VIANA online store.

What is ARS VIANA's purchasing policy?

The buyer may directly purchase any of the limited edition works and other products available in the ARS VIANA virtual store of the artists © Hugo and Alejandro Viana, by accessing the Shopify e-commerce web platform by following the link to the URL: http://arsviana.myshopify.com where they can make their purchase by electronic transaction quickly, efficiently and safely.

What is ARS VIANA's information and privacy management policy?

Each buyer's information is recorded on the Shopify Platform through the Purchase Record Information in its Payment Gateway.

What is the process/mechanism to identify PEPs (publicly exposed persons) of your clients?

In Colombia, the Superintendency of Companies and the Financial Information and Analysis Unit (UIAF) supervise companies and entities required to carry out PEP controls. In this case, ARS VIANA, as an e-commerce platform in Colombian territory and attached to the Shopify Starter Plan with PayPal and PayU Payment Gateway, through its information management technologies and privacy policies, has the respective processes and mechanisms for fully automated PEP Verification. 

Does ARS VIANA cross-check sanction lists for its clients? If so, what sanction lists do they use?

ARS VIANA takes into account those published by the platform with URL address: https://www.tusdatos.co, as a tool that helps identify legal, financial or contagion risks. This allows informed decisions to be made that prevent operational and reputational damage.

Does ARS VIANA have any Money Laundering and Terrorism Financing Policy?

ARS VIANA, affiliated with the Shopify Starter Plan and PayPal and PayU Payment Gateway, certifies that it is understood that it is provided with the subscription to this e-commerce service as an online store and that its resources do not come from or are destined to the exercise of any illicit activity or activities related to money laundering or the financing of terrorism. Likewise, it declares that the economic resources collected from the online sale of works of art on the ARS VIANA platform come from legal activities. Likewise, it declares and ensures that once the ARS VIANA online store becomes active, all electronic transactions carried out through Shopify e-commerce technology with its PayPal and PayU Payment Gateways are not related to or come from illicit activities, particularly money laundering or the financing of terrorism.
